1. Participation in the competition is only possible after the participant has accepted and confirmed these terms and conditions. By entering the competition, entrants accept these terms and conditions.
2. NH Private Equity B.V. (hereinafter NH Hotel Group), Kruisweg 577, 2123 NA Hoofddorp, is running an Instagram Hashtag giveaway called ‘nhow Staycation’.
3. This giveaway is not sponsored, supported or organized by Instagram. Instagram is just the platform on which the NH Hotel Group organizes the giveaway, so Instagram is not affiliated with the competition and are not available as contact persons for the competition.
4. Participation in the competition is possible in the period from 29.05.2020 at 10:00, closing date for entries is 31.05.2020 at 23:59.
5. Participation is open to persons who are at least 18 years old at the time of their participation.
6. Every day, NH Hotel Group will announce a daily winner on their Instagram Profile. The giveaway is hosted by the NH Hotel Group every day, by nhow Amsterdam RAI’s Instagram profile. The task is to post a picture on your Instagram stories of your ultimate staycation at home. Using hashtag #nhowstaycation, between 29.05.20 and 31.05.2020. Participation is only possible online via an Instagram profile.
7. Sweepstake: The sweepstake allows entrants to win a prize by posting a picture on Instagram using the above entry mechanic. A winner will be drawn daily from all participants.
8. The participant commits to legally compliant behaviour. In the context of his reply, he may make no illegal or immoral statements, including in particular insults and false allegations of fact. Third-party rights, namely intellectual property rights and rights resulting from data protection, must be upheld. In the event of a breach, the participant will indemnify NH Hotel Group from all related third-party claims and expenses, in particular the costs of a necessary legal defence.
9. Prizes: 4x a surprise box with goodies from nhow Amsterdam RAI.
10. Winners will be announced via Instagram. For further contact you will be asked to send an e-mail to n.foe@nh-hotels.com. Via an e-mail, the winners will receive further information on the processing of the prize. The NH Hotel Group assumes no liability if, for reasons for which it is not responsible, the prize notification via the electronic transmission is lost and / or is not received. Should the winner fail to respond within 72 hours and accept the prize in writing, a new winner will be drawn. The prize claim is non-transferable and only usable by the original winner. Should the NH Hotel Group not be able to provide the prize for justifiable reasons, NH Hotel Group may substitute an equivalent prize.
11. The participant allows NH Hotel Group to re-post and share the winning picture and will make no copyright claims against the NH Hotel Group.
12. The NH Hotel Group will only collect, process or store the customer data received during the sweepstake in connection with the handling of the sweepstake. For the purpose of profit management, NH Hotel Group or a third party commissioned to do so is entitled to collect and store the data necessary for this purpose. The data will be treated confidentially.
13. After the end of the raffle, the personal data will be deleted.
14. It is not planned to transfer the data for advertising purposes to other third party companies or other third parties. If the NH Hotel Group wishes to pass on this data, it undertakes to obtain the consent of the persons concerned in advance. Without consent, the personal data will not be transferred. This consent can be revoked at any time by e-mail to communication.ce@nh-hotels.com.
15. NH Hotel Group reserves the right to change or terminate the sweepstake at any time. This applies in particular if due to technical reasons (for example, through manipulation of the sweepstake) proper execution is not guaranteed.
16. The prize is not transferable. A cash payment of any profits cannot be made.
17. NH Hotel Group employees and their relatives are excluded from participation. The participation is to be done personally. Employees of the agencies commissioned for this raffle, as well as employees of the participating companies are also excluded from participation. Participation in the raffle by third parties, in particular third parties who make registrations of individual persons commercially with different teleservices providers (registration services or entry services) are not permitted.
18. Participation in the raffle is free of charge and not tied to a hotel booking. No additional costs are associated with the competition.
19. Each of the parties to this Agreement irrevocably agrees that the Dutch court shall have exclusive jurisdiction to hear and decide any suit, action or proceedings, and/or to settle any disputes, which may arise out of or in connection with this Agreement or its formation or validity and, for these purposes, each party irrevocably submits to the jurisdiction of the Dutch court.
20. This agreement, and any dispute, controversy, proceedings or claim of whatever nature arising out of or in any way relating to this agreement or its formation (including any non-contractual disputes or claims), shall be governed by and construed in accordance with Dutch law.
21. Should individual provisions of the conditions of participation be or become invalid, the validity of the remaining conditions of participation remains unaffected.
